Labor law firms Zakay Law Group, APLC and JCL Law Firm, APC file class action lawsuit against Sagar Holding Corporation (Wingstop) alleging non-payment of all wages owed

LOS ANGELES, November 29, 2021 / PRNewswire-PRWeb / – The Los Angeles County lawyers in labor law, at Zakay Legal Group, APLC and Law firm JCL, APC, filed a class action lawsuit against Sagar Holding Corporation, a Wingstop (“Wingstop”) franchisee, for allegedly failing to accurately pay employees’ wages for all of their working time. The Wingstop class action lawsuit, Case No. 21STCV38872, is currently pending in the Los Angeles Superior Court of the State of california. A copy of the complaint can be read here.

According to the lawsuit, Wingstop allegedly violated sections of the California Labor Code §§ 201, 202, 203, 204, 210, 226, 226.7, 246, 510, 512, 551, 552, 1194, 1197, 1197.1, 1198 and 2802 by failing to: (1) pay overtime; (2) pay a minimum wage; (3) provide required meal and rest periods; (4) reimburse employees for required business expenses; (5) provide detailed and accurate salary statements; (6) provide wages when they are due; (7) failure to provide adequate seating; and (8) non-payment of wages earned.

Due to their rigorous work schedules, Wingstop employees have reportedly not been able to take their meal breaks and have not been fully relieved of their duties during meal periods. Specifically, the lawsuit alleges that employees were occasionally interrupted during their meal breaks to perform duties for Wingstop. Employees would have been required to perform work ordered by Wingstop for more than five (5) hours during a shift without benefiting from a meal break outside working hours. Further, the lawsuit alleges that Wingstop failed to provide employees with a second out-of-service meal period each working day in which such employees were required by Wingstop to work ten (10) hours of work. Wingstop’s policy reportedly required employees to remain on-call and on-duty during what was supposed to be their off-duty meal times. The employees would therefore have lost meal breaks without additional compensation and in accordance with Wingstop’s strict company policy and practices.
